Terms of Service
Humble Badge LLC
Effective Date: May 1 2026 Last Updated: May 1 2026
1. Welcome to Humble Badge
Humble Badge helps you track, celebrate, and collect badges for personal achievements—hikes, rides, climbs, and other milestones. We're excited you're here.
These Terms of Service ("Terms") are a legal agreement between you and Humble Badge LLC, a Washington limited liability company ("Humble Badge," "we," "us," or "our"). They govern your use of the Humble Badge iOS application, the website at humblebadge.com, and any related services (together, the "Services").
By creating an account, signing in, or using the Services, you agree to these Terms, our Privacy Policy, and our Community Guidelines. If you don't agree, please don't use the Services.
If you're using the Services on behalf of an organization (a scout troop, a club, a youth group), you confirm you have authority to bind that organization, and "you" refers to both you and that organization.
2. Who Can Use Humble Badge
You must be at least 13 years old to create an account.
If you're between 13 and the age of legal majority in your jurisdiction, you confirm a parent or guardian has reviewed and agreed to these Terms on your behalf.
Humble Badge is not designed for, directed at, or marketed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have, we'll delete the information and terminate the account.
You may not use the Services if you're barred from doing so under applicable law, including U.S. export controls or sanctions.
3. Your Account
3.1 Signing in
Humble Badge uses passwordless authentication. You sign in by entering your email address and the one-time code we send to that address. Keep access to your email account secure—anyone who can read your email can sign in as you.
3.2 Accuracy
Provide accurate information when you create your account, and keep it current.
3.3 One person, one account
You may not maintain multiple accounts to circumvent limits, evade enforcement actions, or misrepresent your identity. You may not share your account or transfer it to anyone else, except through transfer mechanisms we officially provide.
3.4 Responsibility
You're responsible for all activity on your account, including content you post and badges you earn. If you suspect unauthorized access, contact us at support@humblebadge.com right away.
4. The Services
4.1 What Humble Badge does
Humble Badge lets you log personal achievements—hikes, rides, climbs, milestones, and other activities—and earn collectible digital badges. You can build collections, share your achievements with people you connect with, and (if you choose) post to a public activity feed.
4.2 Verification
Some badges require verification. Depending on the badge, verification may use:
- GPS coordinates captured at the moment you tap to earn the badge
- Photos you attach, including embedded GPS and timestamp metadata
- Summary activity data from Apple Health or Garmin FIT files (such as duration and distance)
We describe these data flows in our Privacy Policy. We may decline to award a badge, or revoke a previously awarded badge, if we determine in good faith that the verification requirements were not met.
4.3 Changes to the Services
Humble Badge is actively developed. We may add, change, or remove features at any time. If we discontinue the Services entirely, we'll give you at least 30 days' advance notice and a way to export your content.
4.4 Beta features
We may label some features as "beta," "preview," or "experimental." Beta features are provided as-is, may not work reliably, and may be modified or removed at any time without notice.
5. Acceptable Use
We want Humble Badge to be a place that celebrates real achievement, treats people well, and respects the outdoors. To that end, you agree not to:
- Violate any law, regulation, or third party's rights, including intellectual property and privacy rights.
- Falsely earn badges by submitting fake verification data or otherwise misrepresenting your activities. This includes, but is not limited to, GPS spoofing apps, location simulators, modified Apple Health data, edited FIT files, manipulated photo metadata, or any tool designed to bypass verification. We may revoke any badge we determine was earned through fraud.
- Upload content that's unlawful, harassing, defamatory, hateful, sexually explicit, violent, threatening, deceptive, or abusive.
- Upload content that exploits, sexualizes, or endangers minors. We have zero tolerance for child sexual abuse material and will report violations to the National Center for Missing & Exploited Children and law enforcement.
- Impersonate another person or organization, or misrepresent your affiliation with anyone, including Humble Badge.
- Interfere with the Services—introduce malware, attempt to overload our infrastructure, probe for vulnerabilities outside an authorized program, or evade security measures.
- Scrape, crawl, or use automated tools to access the Services beyond what's permitted by our public APIs and
robots.txt. - Reverse-engineer, decompile, or attempt to derive source code from the iOS app, except where applicable law permits.
- Use the Services to send unsolicited communications or to collect information about other users.
- Use the Services for any commercial purpose without our written consent, including selling accounts, badges, or access. (Transfers through mechanisms we officially provide are permitted.)
5.1 Outdoor responsibility
Humble Badge celebrates time outside. With that comes a responsibility to the places and people we share. You agree to:
- Follow Leave No Trace principles—pack out what you pack in, stay on durable surfaces, give wildlife space.
- Respect public-land rules, trail closures, private property boundaries, and local regulations.
- Not share GPS coordinates of sensitive sites such as archaeological resources, raptor nests, sensitive species habitat, or other locations where public exposure could cause harm.
- Not encourage trespassing, property damage, or activity in environmentally protected areas in ways that violate applicable rules of access.
We may remove user-created badges or shared content that we determine in good faith conflicts with these principles.
5.2 Investigation and enforcement
We may investigate suspected violations. We may suspend or terminate accounts, remove content, and cooperate with law enforcement as appropriate. See Section 14 for how termination works.
6. Your Content
6.1 What "Your Content" means
"Your Content" is anything you submit, upload, or create through the Services: photos, badge descriptions, notes, custom badge definitions, collections, your display name and profile photo, and reactions you give to others.
6.2 You own Your Content
You keep all rights you have in Your Content. We don't claim ownership.
6.3 License you grant to us
To operate the Services, you grant Humble Badge a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for example, to resize photos or extract metadata as described in our Privacy Policy), distribute, display, and perform Your Content. This license is limited to providing and improving the Services.
For Your Content that you choose to make public—such as badges shared to the activity feed—you also grant us a license to feature that content in materials promoting Humble Badge, including App Store screenshots, social media, blog posts, and press materials. We'll always attribute properly when we use public content this way.
6.4 No AI training on your content
We do not use Your Content to train artificial intelligence or machine learning models. If we ever propose to do so, we'll give you at least 30 days' advance notice and the opportunity to opt out before any such use begins.
6.5 Your responsibilities
You represent and warrant that:
- You own Your Content or have the rights necessary to grant the license above.
- Your Content doesn't violate these Terms, the law, or anyone else's rights.
- Photos you upload depict real activity you actually performed.
6.6 Removing Your Content
You can delete most of Your Content directly in the app. Our Privacy Policy describes how long deleted content is retained and when it's permanently purged.
We may also remove Your Content if we believe it violates these Terms or applicable law. We're not obligated to monitor Your Content, but we may.
6.7 Account deletion
When you delete your account, the licenses you've granted us in Sections 6.3 and 6.4 terminate within 30 days, consistent with our Privacy Policy retention practices. Content already used in published marketing materials before your deletion may remain in those materials until they're next refreshed.
6.8 Hearts, likes, and reactions
If another user reacts to your shared content, that interaction is part of how the Services work. We may surface those reactions to you and to other users as designed.
7. Public Sharing and the Activity Feed
By default, your earned badges and collections are private. If you choose to share publicly:
- Your badge appears on the Humble Badge activity feed and on any public profile pages you've enabled.
- Public badges show your display name, the badge, and a reduced-precision location (approximately 1-kilometer accuracy).
- You can make a previously public badge private again at any time, but other users may have already seen it, and copies may persist in third-party caches outside our control.
- If you use your device's share sheet to post a badge to an external platform (such as a social network or messaging app), that platform's terms and privacy practices apply to whatever you share.
A note about children in shared content. If you share content publicly that includes children, please be thoughtful about names, faces, and identifying details. Once content is public, you can't fully control where it goes. We strongly recommend not including children's names or recognizable photos in public posts.
We're not responsible for what other users or external platforms do with content you choose to share publicly. Think before you share.
8. Badges, Artwork, and Sponsored Content
8.1 Our badges and artwork
Many badges in Humble Badge are designed and seeded by us. The badge definitions, artwork, names, and visual style associated with these "system" badges belong to Humble Badge and are protected by copyright, trademark, and other intellectual property laws.
Badge artwork may be created using AI image-generation tools based on prompts and creative direction we provide. The resulting artwork is owned or licensed by Humble Badge.
You receive a personal, non-transferable, non-exclusive license to display badges you've earned within the Services and in connection with sharing your achievement on third-party platforms via the share sheet. You may not reproduce, redistribute, or sell Humble Badge badge artwork outside these uses without our written consent.
8.2 User-created badges
If you create custom badge definitions, you grant the license described in Section 6.3. We may decline to display, may modify, or may remove user-created badges that violate these Terms or that we determine are inappropriate for the platform.
8.3 Sponsored badges and paid placement
Humble Badge may feature sponsored badges created in collaboration with partners (for example, parks, brands, or organizations such as REI, the National Park Service, or gear companies) and may show paid promotional placements within the Services.
When sponsored or promotional content appears, we apply the following commitments:
- Clear labeling. Sponsored badges and paid placements are clearly labeled as such (for example, with a "Sponsored" or "Paid" tag) so you can tell them apart from organic content.
- Limited targeting. We may use broad regional context (such as your country or general region) to determine which sponsored or promotional content is most relevant. We do not target individual users based on their behavior, achievement history, friends, or activity patterns.
- No data sharing with sponsors. Partners do not receive your personal information. We may share aggregated, anonymized metrics with sponsors—such as total earn counts, geographic distribution at state-or-coarser precision, time-period patterns, and badge-pairing patterns—as described in our Privacy Policy. We do not share aggregates that could re-identify individuals.
- Editorial control. We retain editorial control over which sponsorships and placements appear in the Services, and we may decline or remove any partnership that conflicts with our values, our Community Guidelines, or applicable law.
You are not required to engage with sponsored or promotional content. Embarking on a sponsored badge collection, earning a sponsored badge, or otherwise participating is always your choice.
8.4 Future features
Humble Badge may, in the future, offer features beyond what's available today. Possible directions include:
- In-app purchases (one-time purchases or paid badge packs)
- Premium subscriptions (tiered features)
- Group challenges (shared goals among connected users)
- Blockchain or NFT functionality (recording badge ownership on a public blockchain)
Any of these features, if and when launched, will be governed by additional terms presented at the time and will be reflected in updates to this agreement and our Privacy Policy with at least 30 days' advance notice. Where these features create new commercial relationships or new data flows, we'll explain clearly what's changing.
Nothing in these Terms today obligates us to launch any of these features or commits you to participating in them.
9. Reporting and Moderation
9.1 Reporting violations
If you encounter content or behavior that violates these Terms or our Community Guidelines, report it through the in-app reporting feature or by emailing [support@humblebadge.com]. Provide enough detail for us to investigate.
9.2 How we handle reports
We use a combination of automated scanning and human review. We work to apply our rules consistently and fairly, and we take action when violations occur. Depending on the situation, we may:
- Remove or restrict access to content
- Issue warnings
- Suspend or terminate accounts
- Cooperate with law enforcement
- Decline to act if we determine no violation occurred
We aim to be fair and proportionate, but we don't guarantee specific outcomes or response times.
9.3 Copyright and DMCA
If you believe content on the Services infringes your copyright, send a written notice to our designated agent that includes:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material and its location on the Services (such as a URL or badge ID)
- Your contact information (address, phone number, email)
- A statement that you have a good-faith belief the use isn't authorized
- A statement, under penalty of perjury, that the information is accurate and that you're the rights holder or authorized to act on the rights holder's behalf
Send notices to: dmca@humblebadge.com
We respond consistent with the Digital Millennium Copyright Act. Our designated agent is registered with the U.S. Copyright Office.
Repeat infringers. We will terminate accounts found to have committed three valid copyright violations. A "valid" violation means a takedown to which the user did not file a successful counter-notice.
Counter-notices. If your content is removed in response to a takedown notice and you believe the removal was a mistake, you may submit a counter-notice using the same channels, including the information required by 17 U.S.C. § 512(g)(3). We will forward valid counter-notices to the original claimant. Unless the original claimant notifies us of a lawsuit within 10–14 business days, we will restore the content.
10. Third-Party Services
The Services integrate with third-party platforms and tools, including Apple Health, Garmin (via FIT file imports), and third-party platforms reachable through your device's native share sheet. Your use of these third-party services is governed by their own terms and privacy policies. Humble Badge isn't responsible for the availability, accuracy, content, or practices of any third-party service.
11. Disclaimers
11.1 General
The Services are provided "as is" and "as available." To the fullest extent permitted by law, Humble Badge disclaims all warranties, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components.
11.2 Outdoor activities and personal safety
Humble Badge is not a safety, navigation, or emergency service. The Services are for tracking and celebrating personal achievements. You are solely responsible for your own safety, decisions, and conduct during any activity you log, including hiking, cycling, climbing, and other outdoor pursuits.
- Do not rely on Humble Badge for navigation, route-finding, weather, trail conditions, or emergency response.
- Bring appropriate equipment, training, supervision, and judgment for the activity you're undertaking.
- Respect public-land rules, trail closures, private property, wildlife, and local regulations.
- Search-and-rescue services do not monitor Humble Badge. If you need help, call local emergency services.
11.3 No medical or fitness advice
Humble Badge isn't a medical device, fitness coach, or health-tracking application. Activity summaries from Apple Health or Garmin are used only to recognize milestone achievements. Don't rely on Humble Badge for medical, fitness, or training decisions. Consult a qualified professional.
11.4 User-submitted content and sponsored content
We don't endorse, verify, or take responsibility for content posted by other users. Any reliance you place on user-submitted information is at your own risk.
Sponsored content reflects the views and offerings of the sponsoring partner, not necessarily those of Humble Badge. We do not guarantee the accuracy, quality, safety, or availability of any sponsored badges, partner promotions, or third-party offerings featured in the Services.
12. Limitation of Liability
To the fullest extent permitted by law:
- Humble Badge will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption, arising out of or related to your use of the Services, even if we've been advised of the possibility of such damages.
- Humble Badge's total cumulative liability arising out of or related to these Terms or the Services will not exceed the greater of (a) the amount you paid Humble Badge in the twelve months before the event giving rise to the liability, or (b) U.S. $100.
Some jurisdictions don't allow these limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Humble Badge LLC and its officers, employees, contractors, and agents from any third-party claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Services
- Your Content
- Your violation of these Terms
- Your violation of any law or third-party right
We may assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.
14. Termination
14.1 By you
You may stop using the Services and delete your account at any time. Account deletion is described in our Privacy Policy.
14.2 By us
We may suspend or terminate your access to the Services if we believe in good faith that you've violated these Terms or applicable law, your account has been compromised or is being used fraudulently, continued access creates legal or operational risk, or we're required to do so by law or court order.
For non-severe violations, we'll notify you of the issue and give you a reasonable opportunity to respond before terminating your account. We'll also give you at least 30 days to export your content before it's deleted.
For severe violations, we may terminate immediately and without prior notice. Severe violations include: child safety violations, content that violates law, fraud or impersonation, security threats to the Services or other users, court orders, and threats to the safety of our users or staff. In those cases, we may delete content immediately if it's evidence of the violation or further harm.
14.3 Effect of termination
When your account is terminated, your right to use the Services ends immediately. Sections that by their nature should survive—including ownership, the marketing license you've granted for content already published before deletion, disclaimers, limitation of liability, indemnification, and dispute resolution—will survive.
15. Governing Law and Disputes
15.1 Governing law
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
15.2 Informal resolution
If you have a dispute with us, contact us first at [legal@humblebadge.com] and describe the issue. Most concerns can be resolved this way. We ask that you give us 30 days to respond before pursuing formal action.
15.3 Venue
If a dispute can't be resolved informally, it must be brought in the state or federal courts located in King County, Washington, and you and Humble Badge consent to the personal jurisdiction of those courts.
Small claims carveout. Either party may bring qualifying claims in small claims court in the claimant's home jurisdiction, regardless of the venue selection above.
15.4 No class actions
To the extent permitted by law, you and Humble Badge agree that any dispute will be brought in an individual capacity only and not as a plaintiff or class member in any class, collective, or representative proceeding.
15.5 Jury trial waiver
To the extent permitted by law, you and Humble Badge each waive the right to a trial by jury in any action arising out of or related to these Terms or the Services.
16. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this document reflects the most recent revision.
If we make a material change, we'll give you at least 30 days' advance notice by email and through an in-app notification, along with a summary of what's changing. Your continued use of the Services after the effective date of the change constitutes acceptance.
If you don't agree to a change, your option is to stop using the Services and delete your account before the change takes effect.
17. Apple-Specific Terms
Because Humble Badge is distributed through the Apple App Store, the following apply to your use of the iOS app:
- These Terms are between you and Humble Badge LLC, not Apple. Apple is not responsible for the iOS app or its content.
- Your license to use the iOS app is limited to use on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms.
- Apple has no obligation to provide maintenance or support for the iOS app.
- If the iOS app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Humble Badge LLC—not Apple—is responsible for addressing any claims relating to the iOS app, including product liability, conformity to legal requirements, and consumer protection claims.
- Humble Badge LLC—not Apple—is responsible for investigating, defending, settling, or discharging any third-party claim that the iOS app or your use of it infringes that third party's intellectual property rights.
- You represent that you're not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you're not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS app, and may enforce these Terms against you.
18. General Provisions
18.1 Entire agreement
These Terms, together with our Privacy Policy, our Community Guidelines, and any additional terms we present for specific features, are the entire agreement between you and Humble Badge regarding the Services and supersede any prior agreements.
18.2 No waiver
Our failure to enforce any right or provision is not a waiver. A waiver is only effective if in writing and signed by us.
18.3 Severability
If any provision of these Terms is unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect.
18.4 Assignment
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
18.5 No agency
These Terms don't create any agency, partnership, joint venture, employment, or franchise relationship.
18.6 Notices
We may give notices to you by email to the address on your account, by in-app notification, or by posting on the Services. Notices to us should be sent to [legal@humblebadge.com] or to the mailing address in Section 19.
18.7 Force majeure
Neither party is liable for failure or delay in performance caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, internet or utility outages, or government action.
